Terms and Conditions
Please find below the ‘Terms and Conditions’ for Rouge Limited t/a BRAD’S, located 9 - 11 Durham Lane, Auckland CBD, Auckland 1010 (‘Venue’) to be read and agreed upon in conjunction with information and terms outlined in the ‘Booking Form’ and ‘Invoice’.
The information below ensures all parties understand the requirements to provide for everyone’s safety and to keep the Venue a well maintained and safe location for all to enjoy.
VENUE
Rouge Limited t/a BRAD’S, address 9 - 11 Durham Lane, Auckland CBD, Auckland 1010 (‘Venue’) its Landlord, Building Owners, Officers, Employees, and Agents.
BOOKING CONFIRMATION
You, the ‘Hirer’ upon completion and return of the ‘Booking Form’ to the ‘Venue’ and/or payment of the ‘Venue Hire Fee’ (in full or part thereof) are contractually securing the ‘Venue’, to hold an ‘Event’ on the ‘Event Date’ for the ‘Booking Period’ during the ‘Event Hours’ as specified on the ‘Booking Form’. In returning the Booking Form and/or processing the Venue Hire Fee payment the Hirer agrees and accepts these Terms and Conditions in full.
PAYMENT TERMS
VENUE HIRE ONLY: A deposit payment of 50% of the 'Venue Hire Fee' only is required to confirm your booking, with the balance due 21 days prior to your 'Event Date'
FURNITURE HIRE, FOOD AND BEVERAGE: A deposit payment of 25% of any 'Furniture Hire, Food and Beverage Fee' is required to confirm your booking, with the balance payable 14 days prior to your 'Event Date'
CONFIRMATION OF NUMBERS (applicable to Furniture Hire, Food & Beverage only): The Hirer is required (unless agreed otherwise in writing between the parties) to confirm final guest number 14 days prior to the Event date.
BOND
The Hirer agrees to pay a $1000 refundable ‘BOND’ (if applicable) held by the Venue as security to cover any costs associated with the Hirer fulfilling their obligations under these Terms and Conditions. Examples include, (but not limited to) breakages, damages to property or additional cleaning. Should the damages exceed the Bond provided the Hirer will be liable and invoiced for all additional reasonable costs.
BOOKING PERIOD
The Booking Period is for 23 hours, beginning at 10.00am on the Event Date through to 9.00am the following day.
Deliveries and collections are permitted only during these times, unless otherwise specified in writing by the Venue or in accordance with the ‘EARLY - LATE ACCESS’ clause.
All items of property owned by the Hirer and their guests must be installed and removed from the Venue within this timeframe. The Venue accepts no responsibility for checking in or handling any items brought into the Venue unless previously agreed in writing.
All items must be packed into the ‘DESIGNATED COLLECTION AREA’ at the conclusion of the event and be removed by 9.00am the day after the Event Date. Items onsite thereafter will incur relocation and storage fees charged to the Hirer at $200 p/h.
EVENT HOURS
The Hirer is permitted to hold the Event between the hours as detailed below, unless otherwise specified in writing. Events held outside these hours may incur additional charges.
Sunday - Monday 10am - 11pm
Last drinks 10pm
Service ends, music off, lights up 10.30pm
Tuesday - Wednesday 10am - 12pm
Last drinks 11pm
Service ends, music off, lights up 11.30pm
Thursday - Saturday 10am - 1am
Last drinks 12.00am
Service ends, music off, lights up 12.30am
EARLY - LATE ACCESS
For an additional fee of $500 + GST or POA the Hirer may, a) access the Venue at 3pm the day prior to the Event Date for the purposes of installation and delivery only, or b) extend the Booking Period to 3pm the day after the Event Date for the purpose of pack-down and collection only, if first approved in writing by the Venue. It is understood between the Parties that this confirmation will only be granted by the Venue 7 days prior to the Event Date.
DESIGNATED COLLECTION AREA
At the conclusion of your Event all items brought into the Venue by the Hirer or their Contractors must be removed or packed down into one of the Designated Collection Areas ready for pick up and removal by 9.00am following the Event Date. Failure to adhere to this clause will result in fees being charged in accordance with the terms contained under the Booking Period clause above.
DELIVERIES, COLLECTIONS - ACCESS IN AND OUT
All goods in and out of the Venue must be received through the main entrance doors, the adjacent fire exit, through the Wilson Car Park fire exit (costs to enter and exit car park may apply) or through the First Floor fire exit door on Durham Lane.
OBSERVANCE OF BOOKING PERIOD & EVENT HOURS
The Hirer must observe the Booking Period and the Event Hours and arrive and leave within the agreed timeframe.
GST
All amounts exclude GST (unless otherwise specified).
CAPACITY
Standing 506 guests, seated 380 guests, across both floors.
INCLUSIONS
The Venue Hire Fee payment includes all cleaning and rubbish removal to a fair and reasonable standard. For the sake of clarity any additional cleaning time taken over 2 hours will incur additional cleaning costs at $100 p/h to be invoiced and deducted from the Bond.
VENUE HOST
Included in your Venue Hire Fee is a Venue Host who will be available (onsite or when offsite via phone) throughout the duration of your Booking Period for access, troubleshooting and Venue care. For sake of clarity , the responsibilities of a Venue Host do not include those of a Venue Event Manager as detailed below.
VENUE EVENT MANAGER
Available at $40 + GST per hour to help plan and organise your Event ensuring that everything runs smoothly on the day - welcoming guests, answering question, and liaising with support staff and suppliers. If you require services such as these, please advise on booking.
SECURITY
Events where alcohol is served require a registered and approved security company as approved by the Venue. The requirements will be discussed with the Hirer, prior to the Event Date with final discretion to sit with the Venue.
SERVICES
Any additional services agreed in writing between the Parties, and provided by the Venue, such as security will be invoiced to the Hirer and payable 14 days prior to the Event Date.
CANCELLATION OR POSTPONEMENT
In the event of Cancellation or Postponement of the Event Date for any reason, by either party, the Venue Hire Fee is 100% transferable at the same value to any date, to any person or company within 24 months in advance of the original Event Date, as availability prevails at the Venue at the time of application. No refunds of the Venue Hire Fee will be made.
COVID RESTRICTIONS
In the circumstance where your Event Date cannot proceed due to Government enforced COVID-19 Restrictions, the Cancellation or Postponement clause (as detailed above) will apply.
SPECIAL LICENCES
Special Licences to extend the hours, music/noise limits and the like may be applied for. Any additional fees applicable will be met by the Hirer and paid to the appropriate authorities.

PUBLIC EVENTS
TICKETED
All public events must be ticketed - NO EXCEPTIONS (unless previously agreed in writing by the Venue). This is to ensure that the number of attendees to the Venue do not exceed the permitted number of attendees allowed within the venue or outside the Venue at any one time. (See traffic management below).
HEALTH & SAFETY PLAN
A health and safety plan must be provided by the Hirer to the Venue and its contractors at least 7 days prior to the event date; so that everyone working at the event can refer to it. The health and safety plan for your event may form part of any documentation submitted to the local council to get your permit.
TRAFFIC & PEOPLE MANAGEMENT
Given there may be a large queue of people waiting to enter your event or being dropped off to a specific location at a specific time in vehicles you may need to organise and/or pay for traffic management to minimise this impact and disturbance to the venues neighbours and the wider community.
HIRER RESPONSIBILITY POLICY
A responsible service of alcohol policy applies at all times. The Hirer shall ensure, no persons under the age of 18 years shall be served with or allowed to consume alcoholic liquor. No alcohol is to be consumed outside the Venue unless there is a designated area to do so. The Hirer shall be responsible for the good conduct of their guests. The Venue reserves the right to remove any guest from the Venue, at their sole discretion if they feel they are overly intoxicated or abusive.
SMOKING
Smoking of Tobacco or Vaping products is not permitted inside.
USE OF VENUE
The Hirer and guests shall behave in an orderly manner and fully compliant with applicable laws. The Hirer is responsible for the conduct of their guests. The Venue reserves the right to remove any person from the Venue who have or in the opinion of the Venue are likely to cause injury, damage, or behaved inappropriately at their sole discretion.
CARE OF VENUE
The Venue and facilities must be left in a reasonably clean and tidy condition. The Hirer will be responsible for any expense in connection with repairs, damage, breakages or loss of equipment.
FIRE EQUIPMENT
Inappropriate use of any Fire or Fire Safety Equipment resulting in any Liability or loss to the Venue will be passed on and invoiced to the Hirer.
INSURANCE AND LIABILITY
The Hirer agrees to indemnify, defend and hold the Venue, its Landlord, Building Owners, Officers, Employees, and Agents harmless of, and from any liabilities, costs, penalties, or expenses that arise or result from the Hirers use of the Venue.
CONDUCT
The Venue has a zero tolerance policy for: drug use, disparaging remarks of any type, physical violence. The Hirer and guests are not permitted to take into or use the following substances without the premise without the prior written consent of the Venue: fireworks or flammable substances, chemicals deemed toxic or dangerous, prohibitive substances.
CATERING STANDARDS
Insurance - All caterers contracted to work at the venue are required to have a valid and current certificate of Liability insurance on file and available to view by the Venue on request. The Kitchen will be provided in a clean condition and the space should be returned to a clean condition following your event. Caterers must remove all trash, composting and recyclables from the site and dispose in the waste bins provided.
MUSIC AND NOISE
A DJ and/or Band are permitted. Volume levels are at the discretion of the Venue. Music and noise are to be restricted to a reasonable level. All music and noise must cease by 1.00am. The level of noise emissions shall not exceed acceptable council levels at the time. In the event of repeated disturbances at the Venue, the Venue at its sole discretion may expel the Hirer from the Venue and/or end the offending noise. In the event of disturbances to the point of expulsion no portion of the Event Fee and or additional costs will be refundable to the Hirer.

PROPERTY - LOST AND FOUND
The Venue takes no responsibility for personal effects or possessions left at the Venue during or after any Event. Every attempt will be made by the Venue to return any recovered items to its rightful owner.
DECORATIONS
Any fixing points or installation must first be approved by the Venue. All decorations and fittings must be removed at the conclusion of the Event. The Hirer should have the proper insurance cover.
CANDLES / NAKED FLAMES
Must be contained in approved (by the Venue) and appropriate candle holders or glass votives used to prevent wax spill and must meet NZ Health and Safety regulations.
SAFETY
Fire Exits must remain clear of obstruction. Due care must be taken by the Hirer and guests. Children are to be supervised at all times.
ANIMALS
No animals or pets are permitted within the Venue without the prior written consent of the Venue.
BREACH OF CONTRACT
The Venue reserves the right to cancel the Event at any time for breach of the Booking Form, these Terms and Conditions and any additional policies or procedures of the Venue. Failure to comply with the requirements of this policy will be regarded as a breach of the Booking Form and give the Venue the right to cancel, with immediate effect.
ENTRY AND EXIT
The Hirer agrees that the Venue staff or contractors may enter and exit the Venue during and throughout the Booking Period. A representative of the Venue will be available and have contact with Security or your Venue Host during your Event and will be checking periodically with the responsible parties to ensure everything is running smoothly.
BREAKAGES
Will be charged and deducted from the Bond.
LAW
The Hirer agrees to comply with all applicable Local & National laws and shall conduct no illegal act on the premises. The Hirer agrees, for everyone’s safety, to ensure alcoholic beverages are consumed in a responsible manner. The Venue reserves the right, in its exclusive discretion, to expel anyone who in its judgement is intoxicated or under the influence of alcohol or drugs, or who shall in any manner do or participate in any act jeopardising the rights, use permit, or insurability of the Venue or the safety of its staff, guests, or building contents. No person under the age of 18 will be served alcohol.
PROMOTIONS AND COPYRIGHT
Professional imagery of the Venue can be provided for your use in promotional purposes surrounding the Event.
HEALTH AND SAFETY
The Hirer will be aware of, and comply with, any relevant obligations imposed on them under the Health and Safety at Work Act 2015 (the “Act”). The Venue has not and will not assume any duty imposed on the Hirer from time to time pursuant to the Act arising out of this engagement. As the Hirer of the Venue, you must abide by all in house Health & Safety requirements, policies and procedures. Any deliberate act that causes harm to an employee or guest may incur fines under the Health & Safety at Work Act 2015. A signed copy of our Health & Safety Policy must be signed before the commencement of your event. A full disclosure of any Hazards on site will be completed as part of your acceptance to hold an event with us.
